Shore Excursion and Resort Accidents
Were you hurt during a shore excursion?
Eriksen Law Firm handles select cases involving cruise line passengers who have been injured during shore excursions. Both cruise lines and shore excursion companies routinely claim that there is no jurisdiction to sue them in the United States. These are difficult claims and require significant work to successfully bring them to trial in the United States. However, Mr. Eriksen has established several strategies that have lead to successful settlements of such cases.
If you and/or a family member arranged for and paid for a shore excursion activity on board your cruise ship and were injured during that excursion, you may have legal recourse. Even though the shore excursion company may be owned and operated by residents of a specific island or port of call, if that company has contracted with the cruise line to make the arrangements and sell a specific shore excursion to its passengers, the cruise line may be held responsible.
Case in point: A recent shore excursion to a Central American port of call involved cave rafting on a deep, dark underground river. However, the river water had risen to a level that made navigation dangerous, resulting in a passenger hitting her head on the cave ceiling, causing her death. The cruise line contracted with the shore excursion company and sold this trip to its passengers, and was therefore liable for the injury.
